Terms of Service

These Terms apply to Dishcoverie across the website, mobile app, Foodie Pro features, creator tools, content submissions, applications, demos, and related services.

Scope of these Terms

These Terms of Service apply to your access to and use of Dishcoverie, including the Dishcoverie website, mobile application, public discovery pages, Foodie Pro features, creator tools, application forms, demos, content submission tools, communications, and related products or services made available by Dishcoverie from time to time.

By accessing or using Dishcoverie, creating an account, submitting content, applying for Foodie Pro, reserving a creator handle, connecting a third-party account, or otherwise interacting with Dishcoverie, you agree to these Terms. If you do not agree, do not use Dishcoverie.

Eligibility and account responsibility

You must be at least 13 years old to use Dishcoverie. If you use Dishcoverie on behalf of another person, business, creator, restaurant, organization, or legal entity, you represent that you have authority to bind that person or entity to these Terms.

You are responsible for the accuracy of information you provide, for maintaining the security of your account and devices, and for all activity under your account. You must not impersonate another person, misrepresent your affiliation, claim a creator handle or identity you are not entitled to use, or use Dishcoverie for unlawful, harmful, deceptive, abusive, or infringing purposes.

Dishcoverie is a dish and drink discovery service

Dishcoverie helps users discover dishes and drinks through public pages, app features, user submissions, ratings, reviews, recommendations, creator content, and city/category Hype Lists.

Dishcoverie is launching city by city. Some city and category pages may have limited public content while local coverage grows. Features may be experimental, limited, waitlisted, changed, removed, or unavailable in certain markets, devices, regions, or account types.

Dishcoverie is not a restaurant, food seller, delivery provider, health adviser, nutrition adviser, allergen adviser, or menu-verification service. You are responsible for confirming prices, ingredients, allergens, dietary suitability, business hours, location details, availability, and safety directly with the applicable restaurant or third party.

Foodie Pro early access and creator handles

Foodie Pro access may be offered through early access, invitation-only access, complimentary access, promotional access, manual approval, waitlist approval, or another non-paid or limited access model. Applying for Foodie Pro does not guarantee approval, access, visibility, status, monetization, payment, promotion, ranking, or any particular feature availability.

If Dishcoverie allows applicants to request or reserve creator handles, handle requests and reservations remain subject to review, availability, eligibility, conflict checks, policy compliance, identity verification, and final approval. Dishcoverie may reject, cancel, modify, release, or refuse a handle that is misleading, infringing, abusive, inactive, impersonating, confusing, reserved, or otherwise unsuitable.

Approval of a Foodie Pro application or reservation of a creator handle does not create ownership rights in the handle, username, profile, badge, account status, or Foodie Pro designation. Dishcoverie may suspend, revoke, modify, or remove Foodie Pro access or creator status where permitted by law and where reasonably necessary to protect users, brand integrity, platform quality, legal rights, or product trust.

Future paid plans and subscriptions

Foodie Pro and other Dishcoverie features may currently be offered without charge, as early access, as promotional access, as limited access, or as complimentary access. Dishcoverie may later introduce paid Foodie Pro subscriptions, paid creator plans, paid promotional features, paid business tools, paid premium features, or other paid services for new, renewing, upgraded, or existing account types, where permitted by law.

Free, complimentary, promotional, beta, invitation-only, or early-access availability does not guarantee that the same access, features, status, limits, or pricing will remain free or unchanged in the future, unless Dishcoverie expressly states otherwise in writing.

If paid plans are introduced, the price, billing period, renewal terms, cancellation method, refund terms, included features, material limitations, taxes, and other required checkout disclosures will be provided at or before purchase. By purchasing a paid plan, you authorize Dishcoverie or its payment processor to charge the payment method you provide for applicable fees, taxes, renewals, and other disclosed charges.

Unless stated otherwise at checkout, paid subscriptions may automatically renew until cancelled. You are responsible for cancelling before the next renewal date if you do not want to continue the subscription. Cancellation stops future renewal charges but does not automatically entitle you to a refund for amounts already paid, except where required by applicable law or expressly stated at checkout.

Dishcoverie may change, add, remove, suspend, discontinue, bundle, unbundle, reprice, or modify paid or unpaid features, plans, limits, eligibility rules, and benefits, subject to applicable law and any specific terms disclosed to you at purchase.

User Content ownership and responsibility

"User Content" means any photos, images, videos, video links, reviews, ratings, comments, captions, recommendations, profile information, usernames, social handles, restaurant information, dish or drink information, pricing information, reports, feedback, application content, or other content or materials you submit, upload, post, provide, link, transmit, or otherwise make available through Dishcoverie.

You retain whatever ownership rights you may have in your User Content. You are solely responsible for your User Content and for ensuring that you have all rights, licences, permissions, consents, releases, and authority necessary to submit it and to grant the rights described in these Terms.

You represent and warrant that your User Content does not and will not infringe, misappropriate, or violate any intellectual property rights, privacy rights, publicity rights, contractual rights, confidentiality obligations, platform rules, restaurant policies, or other rights of any person or entity, and that your User Content complies with applicable law and these Terms.

Do not submit content you do not own or have permission to use. This includes copied online images, copyrighted photos, music, video, third-party logos used misleadingly, identifiable people without appropriate consent, private information, or any content that you are not authorized to allow Dishcoverie to use.

Licence you grant to Dishcoverie

By submitting, uploading, posting, linking, providing, or otherwise making User Content available to Dishcoverie, you grant Dishcoverie a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable, licence to host, store, cache, reproduce, copy, display, publish, perform, communicate, transmit, distribute, adapt, edit, crop, resize, reformat, translate, excerpt, create derivative works from, promote, market, advertise, and otherwise use your User Content in connection with operating, providing, improving, developing, securing, moderating, promoting, marketing, and advertising Dishcoverie and related products and services.

This licence includes the right for Dishcoverie to use User Content in public website pages, app screens, Hype Lists, category pages, city pages, dish pages, creator/profile surfaces, social media posts, paid or unpaid advertisements, press materials, public relations materials, investor or partner materials, sales materials, demo materials, screenshots, app store listings, emails, newsletters, launch materials, and other marketing or promotional placements, whether online or offline, without further notice, approval, or compensation to you, except where prohibited by applicable law.

You also grant Dishcoverie the right to use your username, display name, profile information, avatar, creator status, badges, attribution, caption, rating, review, recommendation, social handle, city/market, and related metadata in connection with the display, promotion, advertising, and use of your User Content.

The licence continues for as long as reasonably necessary for the purposes described in these Terms, including for content that has already been displayed, shared, distributed, cached, backed up, printed, published, incorporated into promotional materials, or retained for legal, safety, audit, moderation, or business-record purposes. If you delete User Content or close your account, Dishcoverie may remove future public display where reasonably practicable, but prior uses, backups, records, legal retention, moderation records, and materials already distributed may continue to exist.

To the fullest extent permitted by applicable law, you waive, and agree not to assert, any moral rights, integrity rights, attribution rights, or similar rights you may have in User Content against Dishcoverie or its service providers, partners, licensees, successors, or assigns in connection with the uses permitted by these Terms.

Content moderation and takedowns

Dishcoverie may moderate User Content to protect users, public trust, data quality, brand safety, intellectual property rights, privacy, platform integrity, ranking integrity, and legal compliance. Moderation decisions may be manual, automated, AI-assisted, or a combination of those methods.

Dishcoverie may reject, remove, restrict, edit, label, downrank, disable, or refuse to display User Content that appears to violate these Terms, applicable law, third-party rights, community standards, platform integrity rules, moderation standards, or Dishcoverie's product standards.

If you believe content on Dishcoverie infringes your rights, email admin@dishcoverie.com with enough information for us to review the issue, including the relevant URL, app screen, username, content location, a description of the claimed rights, your contact information, and a statement explaining why you believe the content is unauthorized.

Acceptable use

You must not use Dishcoverie to submit unlawful, misleading, fraudulent, defamatory, harassing, hateful, abusive, obscene, sexually explicit, violent, exploitative, infringing, privacy-invasive, spammy, malicious, or otherwise harmful content.

You must not scrape, harvest, reverse engineer, overload, attack, probe, bypass, automate, manipulate, interfere with, or misuse Dishcoverie, its rankings, creator systems, moderation systems, application systems, security controls, or user accounts except as expressly permitted by Dishcoverie in writing.

You must not attempt to manipulate ratings, Hype Lists, reviews, badges, Foodie Pro status, creator handles, recommendations, reports, applications, rankings, or public trust signals through fake accounts, coordinated activity, undisclosed incentives, deceptive submissions, spam, bot activity, or other abusive behaviour.

Public information and accuracy

Public rankings, Hype Lists, ratings, recommendations, discovery surfaces, restaurant information, map links, pricing, photos, videos, creator content, comments, and other public information are provided for general informational and discovery purposes only and may be incomplete, inaccurate, unavailable, outdated, subjective, or change over time.

Dishcoverie does not guarantee the accuracy, completeness, legality, safety, quality, availability, pricing, ingredients, allergens, location details, business hours, menu availability, creator claims, or suitability of any restaurant, dish, drink, creator content, User Content, or third-party information.

You are responsible for evaluating information before relying on it. Dishcoverie is not responsible for decisions you make based on public pages, app content, rankings, recommendations, maps, user submissions, creator content, or third-party information.

Third-party services and links

Dishcoverie may link to, embed, reference, or interoperate with third-party services such as Instagram, YouTube, TikTok, Google, Google Maps, app stores, restaurants, creator platforms, payment processors, hosting providers, analytics providers, authentication providers, or other external websites and services.

Dishcoverie is not responsible for third-party content, policies, practices, availability, security, errors, charges, fees, account actions, or services. Your use of third-party services is governed by the terms and policies of those third parties.

Dishcoverie intellectual property

Dishcoverie, including its name, logos, branding, product concepts, website content, app content, page design, software, features, copy, visual assets, badges, layouts, trade dress, data presentation, and related materials, is owned by Dishcoverie or its applicable rights holders and is protected by intellectual property and other laws.

Except as expressly permitted by Dishcoverie in writing, you may not copy, reproduce, modify, scrape, reverse engineer, sell, rent, sublicense, publicly display, distribute, or reuse Dishcoverie materials in a way that misleads users, suggests endorsement, competes unfairly, violates applicable law, or infringes Dishcoverie's rights.

Feedback

If you send Dishcoverie ideas, suggestions, bug reports, concepts, feature requests, designs, business suggestions, or other feedback, you grant Dishcoverie the right to use, modify, commercialize, and otherwise exploit that feedback without restriction, compensation, attribution, or obligation to you, except where prohibited by applicable law.

No warranties

Dishcoverie is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Dishcoverie disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, security, quiet enjoyment, or uninterrupted operation.

Dishcoverie does not warrant that the website, app, public pages, application flow, data, rankings, recommendations, creator features, Foodie Pro features, paid or unpaid services, or any related service will be error-free, secure, available, complete, current, uninterrupted, or free from harmful components.

Legal operator

Dishcoverie is operated by Silarche Inc., an Ontario corporation. References to "Dishcoverie," "we," "us," and "our" in these Terms mean the Dishcoverie services operated by Silarche Inc.

Limitation of liability

To the fullest extent permitted by applicable law, Dishcoverie and its owners, directors, officers, employees, contractors, service providers, partners, licensors, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, aggravated, or similar damages, or for any loss of profits, revenue, goodwill, data, content, business opportunity, reputation, or anticipated savings, arising out of or related to Dishcoverie, these Terms, third-party services, paid or unpaid features, or User Content, even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Dishcoverie's total aggregate liability for all claims arising out of or related to Dishcoverie or these Terms will be limited to the greater of CAD $100 or the amount you paid directly to Dishcoverie for the service giving rise to the claim in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

Indemnity

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Dishcoverie and its owners, directors, officers, employees, contractors, service providers, partners, licensors, successors, and assigns from and against any claims, demands, actions, proceedings, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to your use of Dishcoverie, your User Content, your breach of these Terms, your violation of applicable law, your violation of third-party rights, your misuse of third-party services, your payment or subscription activity, or your misrepresentation of ownership, permissions, affiliation, identity, or authority.

Changes to Dishcoverie or these Terms

Dishcoverie may modify, suspend, discontinue, restrict, remove, rename, rebrand, or replace any part of the website, app, public pages, Foodie Pro program, creator features, demos, application flow, city coverage, paid or unpaid features, or related services at any time, with or without notice, where permitted by law.

Dishcoverie may update these Terms from time to time. The updated version will be posted on this page with a revised date. Your continued use of Dishcoverie after updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by applicable law.

Governing law

These Terms and any dispute arising out of or related to Dishcoverie are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules, except where mandatory consumer protection, privacy, app-store, or other mandatory local laws require otherwise.

Subject to any mandatory rights you may have under applicable law, you agree that the courts located in Ontario, Canada will have exclusive jurisdiction over disputes arising out of or related to Dishcoverie or these Terms.
